The minister removed the defendants’ lawyers and appointed public defenders in their place.
In a note and video, the lawyer, who defends Martins, protested against what he called Moraes’ arbitrariness. He was also removed, who defends the Chamber.
A former international advisor to the Presidency in the government, Martins sent a handwritten request to Moraes protesting the decision to remove his lawyer and refusing the appointment of a public defender.
“The dismissal, carried out without my hearing and without prior opposition, is abusive and directly violates my inalienable rights, in particular the right to freely choose the defender of my trust, an elementary guarantee in a democratic regime”, states the former advisor.
The reason given by Moraes for the dismissal was the missed deadline for the final arguments in the process, in which Martins and Câmara are defendants.
The lawyers had asked for more time for the allegations, justifying that the Attorney General’s Office added new elements to the accusation. Moraes understood that it was a delaying maneuver and ordered the dismissal.
In addition to appealing the decision and seeking support from the OAB, Chiquini is considering reporting the case to international courts.
