Court has 11 ministers and mandatory retirement at age 75; Barroso, 67, announced early departure

The decision by Minister Luís Roberto Barroso, 67 years old, from (STF) opened space for a new appointment by President Luiz Inácio Lula da Silva (PT) and reignited the debate about the pace of renewal in the country’s highest Court.

With Barroso’s departure, Lula will make his fourth appointment to the STF, increasing the political weight of the current government in the composition of the court, made up of 11 ministers with a lifetime mandate, but subject to compulsory retirement at age 75.

According to the rules, only native Brazilians, aged between 35 and 65 years old, with renowned legal knowledge and an unblemished reputation, can be nominated for the Supreme Court. After being chosen by the president, the name needs to be examined by the Constitution and Justice Commission (CCJ) and approved by the Senate plenary.
