Facebook deletes group of used bottles after AGU action

The Union’s Attorney General says that commerce facilitates counterfeiting of drinks and poses a risk to public health

Facebook deleted a group with more than 11,000 members that sold used bottles of alcoholic beverages, often used to package adulterated products. The removal was carried out after notification from the AGU (Attorney General of the Union), through the PNDD (National Attorney’s Office for the Defense of Democracy).

According to the AGU, the large-scale commercialization of these containers, often with original labels from well-known brands, facilitates counterfeiting of drinks and poses a risk to public health. The body stated that the practice “it undermines state control over products subject to taxation and exposes the population to risks of poisoning, blindness and death”.

The PNDD reported that Facebook preserved the evidence, including posts, names of participants and actions of administrators, which could support police investigations. This is the 3rd notification sent by the unit to the platform in the context of the methanol case.

The national prosecutor of the Union for the Defense of Democracy, Raphael Ramos, stated that the cooperation of private companies is essential to ensure a safe digital environment. “It cannot be accepted that products and content that are harmful to the population circulate, whether in the form of advertisements or through illegal trade without controls”these.

The PNDD also cited a previous request from Senacon (National Consumer Secretariat), the MJSP (Ministry of Justice and Public Security), for e-commerce suspend the sale of inputs used in counterfeiting drinks, such as seals, lids, stamps and non-collectible bottles.

Finally, the body recalled that, according to the decision of the STF (Supreme Federal Court) on the Marco Civil da Internet, digital platforms are responsible for illegal content from third parties. The removed group also violated Facebook’s Usage Policies and Community Standards, which prohibit the sale of illegal or counterfeit products.
