Project reserves money from bets to combat digital crimes

Text links 2% of gaming revenue to the digital security fund and creates a legal framework for cybersecurity

The Senate analyzes a bill that creates a legal framework for cybersecurity and allocates more resources for the FNSP (National Public Security Fund) to apply to combat digital crimes. The PL was proposed by senator Esperidião Amin (PP-SC) and is being analyzed by the CCJ (Constitution and Justice Commission).

According to the text, the legal framework for cybersecurity aims to prevent, mitigate and respond to cyber incidents in a coordinated manner. The project establishes stable and sustainable financing mechanisms for digital security actions, allocating resources from the National Public Security Fund. It also reserves part of the lottery revenue for these actions.

The PL creates the National Digital Security and Resilience Program. Linked to the Union, the plan can count on the adhesion of States, the Federal District, municipalities and private sector organizations. The program’s objectives include:

  • qualify the investigation and combat of cybercrime;
  • establish national, state, district and municipal cyber resilience plans;
  • integrate actions from critical sectors, such as health, education, finance, energy, telecommunications, transport, environment, defense and public security.

Financing

Under current legislation, the FNSP is not obliged to specifically finance actions to combat cybercrime. The project seeks to fill this gap and reserves at least 3% of the fund’s resources for cybersecurity actions. Among other actions, the money must be invested in:

  • public administration technological modernization projects and programs;
  • training and training of human resources in cybersecurity;
  • support for research and innovation in cybersecurity technologies;
  • response centers and cyber incident handling teams;
  • education and awareness campaigns for society.

The project allocates 2% of bets resources to finance actions in the area of ​​cybersecurity. Under current legislation, 82% of the resources go to funding and maintenance expenses for the lottery operating agent, 6% to social security and 12% to other areas. The PL includes cybersecurity in this allocation, reserving 2% of bet revenue for this purpose.

“Escalation of incidents”

For Senator Esperidião Amin, Brazil faces “an escalation of cyber incidents affecting the provision of public services”. He cites as an example the leak of sensitive data from citizens, which puts the stability of various bodies and entities in the country at risk.

“Being the 10th largest economy on the planet, Brazil is practically the only one among the 20 largest in the world that has not yet consolidated a regulatory framework with the force of law to support a State policy in this area. This is a strategic and necessary step to mitigate structural cyber risks, guarantee the integrity of essential public functions and protect Brazilian society from immeasurable damage”says the author in the justification of the project.

National authority

The project suggests the creation of a national cybersecurity authority. According to the text, members of the National Digital Security and Resilience Program must notify the body of the occurrence of cybersecurity incidents considered relevant.

Program participants will be able to count on training projects, alert and response systems and national and international technical cooperation initiatives. Another benefit would be priority access to FNSP resources dedicated to cybersecurity.
