Data from the cell phones of a businessman and a lobbyist are considered the main flanks for advancing na investigations, which investigate suspicions of sale of decisions and leaks in offices of the (Superior Court of Justice).
At the beginning of October, the PF presented a preliminary report on the operation, the first phase of which will complete one year in November. Sisamnes’ report to date.
For now, there are no ministers investigated in the operation, which is under the responsibility of the (Supreme Federal Court). However, according to people with knowledge of the investigations, the investigation should expand based on information whose analysis has yet to be completed by the police.
It is expected that any new developments in the investigation will focus on extracting messages and other information obtained in previous phases of the operation.
One of these cell phones whose data is being extracted is that of Haroldo Augusto Filho, from . He was the target of precautionary measures and search and seizure in the first phase of Sisamnes.
According to the PF, Fource was conceived under the guise of a company specializing in judicial recovery and restructuring of crisis companies, but was “instrumentalized as a mechanism to circumvent creditors and manipulate legal processes for one’s own benefit.”
Part of the processes suspected of having been negotiated in were of interest to Haroldo, his partner Valdoir Slapak and the consulting company.
The information contained on your cell phone can help strengthen current evidence, which was initially obtained from the device of a lawyer murdered in 2023, and locate new people suspected of having committed irregularities.
The Fource group said in a statement that it “vehemently repudiates the content of the Federal Police report, whose fragility is obvious.”
“The document is based on mere relationships and subjective conclusions, without presenting any concrete element or evidence to support the allegations contained therein”, says the company.
“This is a report that ignores the absence of effective irregularities, relying on decontextualized messages and the isolated opinions of a delegate, with no technical or legal basis capable of justifying the conclusions presented”, states the note.
“Once again, we are witnessing a worrying scenario of accusations and unfounded conclusions, typical of an environment with a police bias, in which the right to defense and due legal process are widely attacked and placed in the background.”
The company also says that its defense did not have full access to the investigation documents and that, until now, “the conclusions presented are so frivolous, fragile and devoid of any evidentiary support”.
“Fource deeply regrets the use of the press as a means of disclosing and leaking confidential information, which violates basic principles of due legal process and the right to full defense.”
Another analysis that is expected to open new flanks in the operation is the lobbyist’s cell phone cloud, considered the pivot of Sisamnes and suspected of being the main operator of the scheme.
Some of the data extracted from Andreson’s cloud has already helped to reveal contacts maintained with servers and magistrates who are also suspected of being involved in the scheme involving the STJ.
The new material should show in more depth Andreson’s contact with court employees, including at times after the period that is currently being investigated. The new period under analysis may take the investigation in other directions.
When contacted, Andreson’s lawyer, Eugênio Pacelli, said that “apparently, only this defense is complying with and respecting the secrecy imposed on the investigation” and that he has “avoided commenting on what should not be made public, according to the decision of the reporting minister”.
“But there is something that needs to be said: this investigation began more than a year ago, with arrest and several other precautionary measures. This is public knowledge, unfortunately. But to date, no single reason has been identified as to why this investigation is in the STF”, says Pacelli.
“There are no authorities with jurisdiction in that court being investigated! Jurisdiction conditioned on a future and uncertain event?”, asked the lawyer.
Although ministers are not being investigated, the investigation continues at the Supreme Court, responsible for supervising investigations involving members of the STJ and other authorities with special jurisdiction, for three reasons, according to the PF report.
The first is to prevent measures considered sensitive, including on the premises of the STJ itself, from being annulled. Another reason is to protect the investigation against external interference. The third is to preserve the possibility that new evidence may involve authorities with jurisdiction in the STF — such as the ministers themselves.
Furthermore, a third path for the investigations is to advance the analysis of the companies owned by Nilvan Marques Medrado, appointed as technical-accounting responsible for several companies linked to Andreson and Mirian Ribeiro, the lobbyist’s wife.
According to the PF’s findings, these are road transport, earthmoving and even air taxi companies. Money that is suspected of coming from illegal operations circulated through these companies.
Nilvan, according to investigations, is an accountant for 152 companies, the majority based in Mato Grosso and works in the transport sector. Of this total, 49 were created between 2021 and 2022.
The PF says that this time interval “reveals a pattern of business turnover typical of sophisticated money laundering systems.”
The body requested in-depth corporate analysis of the companies linked to Nilvan, “since the links between partners, family members and public servants can reveal new ramifications of the core of judicial corruption, expanding the scope of evidence and allowing the full mapping of the accounting and financial network that supports the scheme”.
