The Court of São Vicente (SP) ordered a technical assessment of soil contamination on land located in a mangrove area next to the Serra do Mar park, where waste from civil construction, mining and polluting materials are being deposited.
The property belongs to the company PGV Terraplenagem e Gestão de Residues. The decision by the judge of the Public Finance Court, Leonardo de Mello Gonçalves, reverses the decision of the environmental company in the state of São Paulo that dispensed with the study on the soil and authorized its use for disposal of material.
The judge gave Cetesb 15 days to present a proposal for an environmental expert to carry out the assessment.
The popular action was filed by lawyer Guilherme Alves dos Santos Craveiro. She calls for the annulment of the environmental licensing process and the condemnation of Cetesb and PGV to promote the complete decontamination of the area and the repair of environmental damage.
Exams carried out by a laboratory at the request of the Civil Police had confirmed the presence of elements such as arsenic, mercury, lead and benzopyrene at the site.
Last year, the police investigated the possible practice of environmental crime and the influence of Cetesb public servants in actions that benefited companies in the region in the use of waste landfills. There was a search and seizure of the homes and workplaces of some of those involved.
The investigation is based on an inquiry by the Special Action Group for Environmental Defense of the Public Ministry.
