Deputies linked to the (Landless Rural Workers Movement) filed last Wednesday (22) a bill to create a bill, in response to the approval, by the CCJ (Constitution and Justice Commission) of the Chamber, of registration of land invaders.
The parliamentarians’ project adds a provision to the law that establishes agrarian law standards that punishes imprisonment for five to ten years. The act is described as the use, as proof of possession or property and rights relating thereto, of , to the detriment of another person or for one’s own benefit.
The text also creates the National Register of Landgrabbers, which may be formed by individuals or legal entities. Deputies expect the list to be updated monthly with incidents of land grabbing of public or private properties.
This registry must contain location with georeferenced data of the area, registration with the registry office and status with the area’s Rural Environmental Registry and the National Registry of Rural Properties. In addition, CPF or CNPJ of the person committing the land grabbing.
The proposal says that if the area that is the target of land grabbing is occupied by people, for example, the facts must be communicated immediately to the Federal or State Public Ministry.
Furthermore, it determines that the execution, by official forces, of eviction actions against these people without observing due legal process is a crime of responsibility.
Anyone registered on the national register of land grabbers will not be able to access rural credit and will also not be able to be appointed to public office or elective office.
The project is a response to the text approved on October 1st by the CCJ that creates a register of people involved in land occupations.
