The minister scheduled the trial against his former advisor in the First Panel of the (Supreme Federal Court) for next week.

The trial will begin on November 7th, with a deadline for including votes on the 14th. The Panel is made up of ministers Alexandre de Moraes (rapporteur), , and .

The (Attorney General’s Office) of committing crimes of violation of functional secrecy, coercion during the process, obstruction of investigation and attempt to abolish the Democratic Rule of Law.

The complaint takes into account the leak of messages from members of Moraes’ cabinet throughout 2022. , conversations show that the minister used the (Superior Electoral Court) outside the traditional rite to produce reports and open investigations against Bolsonaro supporters.

Eduardo Tagliaferro is in Italy and, in recent months, participated in lives with supporters of former president Jair Bolsonaro (PL), promised to make new revelations about Moraes and prepared a dossier to denounce the Supreme Court minister.

According to prosecutor Paulo Gonet, Tagliaferro “revealed confidential information that he obtained due to his position, with the aim of obstructing investigations and favoring his own and others’ interests.”

The PGR also says that the departure from Brazil demonstrates the alignment of the former TSE advisor with the criminal organization responsible for undemocratic acts.

“The recent public announcement (07/30/2025), in a foreign State, of the intention to reveal new confidential functional information, including launching a fundraising campaign to finance its criminal intent, meets the criminal organization’s purpose of trying to prevent and restrict the free exercise of Judiciary Power”, stated in the complaint.

“The objective of inciting new undemocratic acts and causing the spread of false news against the Supreme Court is clear,” he adds.

Tagliaferro’s defense says that the complaint is inept because it does not describe which criminal organization the former advisor was part of. “For the crime of coercion during the course of the process, there is no concrete conduct that conforms to the legal concept of ‘serious threat’, elementary to the criminal type attributed to the Defendant”, states lawyer Eduardo Kuntz.
