Toffoli backs down and votes to annul Lava Jato actions against former Petrobras director

Minister Dias Toffoli, of the Federal Supreme Court (STF), changed his position and voted to annul all Lava Jato processes against former Petrobras director Renato Duque, detained since August 2024.

The decision was taken in the trial of an appeal presented by the defense, which accuses former judge Sergio Moro and the operation’s prosecutors of acting in collusion during the investigations.

The case is analyzed by the 2nd Panel of the STF, in a virtual plenary session. Toffoli had rejected the request in his first statement, but revised his understanding and began to follow the vote of minister Gilmar Mendes, who defended the revocation of Duque’s arrest and the nullity of all evidence and decisions taken at the time.

“I readjust the vote to follow Minister Gilmar Mendes’s vote in its fundamentals”, recorded Toffoli in the new opinion.

With the change, the score tends to consolidate in favor of the annulment. The votes still remain for Luiz Fux, Nunes Marques and André Mendonça, who have until November 10th to express their opinion.

Renato Duque was one of the main targets of Lava Jato and was convicted in several cases. He maintains that the evidence used against him was obtained irregularly and that Moro had directed the investigations.

Operation Lava Jato, launched in 2014, revealed a broad corruption scheme involving Petrobras, political parties and large construction companies. In recent years, the STF has reviewed operation decisions, annulling sentences and recognizing excesses committed by the task force.
