At the STF, Dino suspends actions that discuss the validity of the Soy Moratorium in Justice

According to the minister, the action seeks to contain ‘exaggerated litigation’ and legal uncertainty on the subject

The minister, of the Federal Supreme Court (), ordered the national suspension of all processes that discuss the validity of the Soy Moratorium in the Courts and in the Administrative Council for Economic Defense (Cade). The decision complies with the Brazilian Association of Vegetable Oil Industries (Abiove). According to Dino, the suspension seeks to contain “exaggerated litigation” and legal uncertainty on the topic. The injunction is valid until the final judgment of the case, which is reported by Dino in the Supreme Court. The minister submitted the decision to a plenary referendum in a virtual analysis that begins on November 14th and runs until the 25th. “The debate in this concentrated control action, and in other similar ones, has the merit of seeking a safe legal framework for all companies in the important Agribusiness segment.

Exaggerated litigation is incompatible with this virtue, with multiple disputes, spilling over prematurely, to other judicial and administrative bodies, conflicts between companies involving billions of reais”, stated the minister in the decision published this Wednesday (5). For the minister, excessive judicialization causes a “legal turmoil even before final decisions of the STF, with the potential to generate serious economic consequences as the various links in this production chain are interconnected, including reaching external actors”.

Dino considered that requests for compensation and sanctions can be formulated by companies against others, but that “there is time and way for this debate – after the STF establishes its definitive understanding”. He highlighted that to date there is no decision by the STF that has declared the “Soy Moratorium” unconstitutional.

The action was filed in the STF by PCdoB, PSOL, PV and Rede. In December last year, Dino responded to a request from the parties to fully suspend the effectiveness of Mato Grosso’s law that prohibits the granting of tax benefits to companies that participate in agreements such as the Soy Moratorium. In April of this year, he reconsidered the decision and reestablished the effects of the rule from January 1, 2026.
