Elderly people are entitled to R$600 per month even with debts; understand the law

A Lei nº 14,181/2021known as Super-Indebtedness Lawbrought important advances to the financial protection of retirees and pensioners. One of the main points is the creation of existential minimuma value that cannot be compromised by debts, currently set at R$600 per month.

The measure prevents financial institutions from withdrawing all income from the elderly, even in situations of multiple loans, automatic discounts or legal charges. This resource is intended to guarantee basic sustenance, including food, housing, transportation, medicine and health care.

In addition to protecting minimum income, the law promotes financial educationrequiring banks and financial institutions to clearly inform credit conditions and assess customers’ real payment capacity. They were also created debt reconciliation centerswhich help consumers and creditors to renegotiate debts in a balanced way, without harming the existential minimum.

For experts, the law represents a significant advance in defending the rights of the elderly, preventing over-indebtedness from compromising their dignity and offering the opportunity to reorganize finances with more security. In case of non-compliance, the elderly person can appeal to consumer protection bodies or to the courts.
