MPF takes Abin director to court due to report – 11/16/2025 – Panel

The filed a writ of mandamus asking the director general of the (Brazilian Intelligence Agency), to present reports produced during the pandemic with warnings to the government about the.

The initial petition was presented last Tuesday (11) by Public Prosecutor Igor Jordão Alves to the 9th Federal Court of the Judiciary Section of Amazonas. In the document, he states that Abin refused to provide information requested by the MPF, which led to the presentation of the writ of mandamus.

In the document, Jordão Alves asks the general director of Abin to comply, within 48 hours, with the request to forward all reports prepared by Abin between March 2020 and January 2021 on . The state suffered a crisis that resulted in the death of dozens of patients from asphyxiation.

The prosecutor also requests access to all communications that prove that the reports produced were passed on to the authorities of the Federal Executive Branch and information and evidence on any communications of data to the government of Amazonas and the municipality of Manaus.

Jordão Alves says that the request for access to the reports seeks to facilitate “reparation and compensation for the victims of the medical oxygen shortage crisis in the State of Amazonas, which occurred in January 2021”.

The prosecutor cites the publication of reports that mention the existence of reports produced by Abin in which the body informed the federal government about the possibility of saturation of the health network in Amazonas. However, it states that, when the MPF formally requested access to the data via official letter, it did not receive a response from the intelligence agency.

“Obtaining the reports produced by Abin is essential to corroborate the predictability of harmful events, which is why it constitutes relevant evidentiary material for establishing the civil liability of federative entities”, he states.

In the document, the prosecutor says that the “unjustified refusal of the enforcement authority to comply with the request, therefore, obstructs the constitutional right-duty of the Public Prosecutor’s Office to safeguard fundamental rights and to promote the measures necessary to guarantee them, making the act of omission directly harmful to the liquid and certain right now invoked”.

According to Jordão Alves, the information is of public interest and is not subject to secrecy.

Abin informs that it was not notified about the warrant. Members of the agency say that all available information has already been delivered through the Civil House and that more than 1,100 documents relating to Covid-19 are public and available on the Abin website.
