Former Secretary of Justice of the state of São Paulo, lawyer Belisário dos Santos Jr. says that the bill that reduces penalties for coup plotters goes against legal norms because it was created to specifically benefit former president Jair Bolsonaro.
“Characteristics of a legal norm are its generality and abstraction. There cannot be a norm addressed to a certain and determined person. In the case of this law, it is clearly and unquestionably directed at Bolsonaro and those who, with him, attacked the Rule of Law”, says the .
“The crimes for which they were convicted [os envolvidos na tentativa de golpe] imply a violation of the Rule of Law, which would again be affected by the rule, minimizing legal protection”, adds Belisário, who held the position of state secretary during the governments of Mário Covas, between 1995 and 2000.
