The proposed salary adjustment for permanent employees of the Judiciary, this Monday (22), was one of the priorities of the president of the STF (Supreme Federal Court), minister Edson Fachin.
Since assuming command of the Court, Fachin has publicly defended the appreciation of the judiciary and Judiciary employees. Last Friday (19), for example, when speaking at the end of the Judiciary year, the minister once again highlighted the topic as one of the priorities for 2026. “For 2026, I believe we have a meeting scheduled with some relevant topics, among them: remuneration for the judiciary”, he stated.
When the recomposition proposal was still being processed in Congress, Fachin even met with the presidents of Hugo Motta, Davi Alcolumbre, to defend the approval of the text.
The STF argues that it is necessary to correct inflationary losses accumulated since 2019. According to the Court, this is not an increase in salary, but a necessary recomposition that has not been done for years.
In the Legislature, the articulation worked. The proposal was approved in both Houses in rapid processing, providing for an adjustment in three cumulative installments of 8%, to be paid in 2026, 2027 and 2028. The correction covers the basic salaries of permanent positions, commissioned positions and commissioned functions of employees of the Judiciary.
Upon arriving at Palácio do Planalto, however, the text was partially blocked. Lula decided to sanction only the first installment of the adjustment, which will begin to be paid on July 1, 2026.
According to the government, the installments scheduled for 2027 and 2028 would cause an increase in expenditure in periods subsequent to the end of Lula’s term, which contradicts the fiscal responsibility law.
In article 21 of the legislation, it is stated that any act that results in “an increase in personnel expenses that foresees installments to be implemented in periods subsequent to the end of the incumbent’s term of office” will be null and void.
Another proposal defended by Fachin was the creation of the Additional Qualification (AQ) for employees in Judiciary careers. The text had been approved in Congress and was fully sanctioned by Lula this Monday.
The benefit will be granted to employees who have participated in training actions, completed undergraduate courses or obtained titles, diplomas or postgraduate certificates, in addition to professional certifications.
