Moraes assumes presidency of the STF after Fachin goes into recess

Minister Alexandre de Moraes temporarily assumes the presidency of the Federal Supreme Court (STF) this Monday (12) with the beginning of the recess period of the President of the Court, Minister Edson Fachin. Moraes will head the Court until the end of January.

The change occurs because the Judiciary is on recess from December 20th to January 31st. During this period, Fachin, current president of the Court, was responsible for the shift between December 20th and January 11th. As of this Monday, Moraes, as vice president, will be responsible for the Presidency and judicial duty until January 31st.

It is not the first time that Moraes has temporarily assumed command of the STF. In November last year, the minister presided over the Court during the absence of Fachin, who was in Belém (PA) to represent the Brazilian Judiciary at COP30.

The STF plenary formalized, in August, the choice of Fachin and Moraes for the positions of president and vice-president. Both took office in September, after the end of the administration of minister Luís Roberto Barroso, who retired.

The election follows a rule of seniority and rotation among ministers. According to the rotation criterion, Moraes must assume the presidency definitively in 2027, as he is the oldest minister who has not yet commanded the Court.

Judicial duty

Judicial duty takes place to assist those under jurisdiction and lawyers in urgent cases on days when there are no regular court hours, such as during the recess from December 20th to January 31st.

During this period, requests related to matters set out in the shift regulations must be filed exclusively electronically, with processing hours from 9am to 1pm.
