AGU reduces the Union’s fiscal risk by R$ 1.25 tri since 2022 – 01/29/2026 – Panel

A survey by the Attorney General’s Office () calculates that the body has reduced the Union’s judicial fiscal risk by R$1.25 trillion since the beginning of the Lula government, preventing unfavorable court decisions from affecting public accounts.

The decrease was 36.3%, with liabilities falling from R$3.43 trillion in 2022 to R$2.18 trillion last year, a decrease of 36.36%.

The AGU is responsible for defending the Union in judicial actions and monitoring possible tax bombs. To this end, there are bodies such as the General Secretariat for Litigation, the Federal Attorney General’s Office, the Federal Attorney General’s Office and the National Treasury Attorney General’s Office.

“Our dedicated and strategic action, focused on improving risk governance, will avoid the payment of R$ 1.25 trillion in court orders”, says the Union’s attorney general, . “These are significant resources that can now be used in public policy actions and programs in areas essential to the population, such as health, security and education”, he adds.

In 2025 alone, the decrease in fiscal risk was 16.32%, or R$425.4 billion, according to AGU.

Among the favorable decisions listed by the government body is the acceptance by the STF of a proposal to correct the establishment of remuneration that guarantees the official inflation index (IPCA). This action alone avoided a loss estimated at R$259.9 billion.

Another example was the STF’s decision to maintain the limit on the deduction of education expenses from the calculation. The process had a potential impact of R$114.9 billion on public coffers.

The AGU also lists a decision by the STF that maintained the rules of the Special Regime for the Reinstatement of Tax Values ​​for Exporting Companies (Reintrega). If the actions were deemed valid, the impact on public accounts, estimated by the Federal Revenue Service, would be around R$50 billion.
