Delegate associations ask for more power in investigations – 02/13/2026 – Panel

Amid the clashes with the minister in the Master case, delegates asked the president of the Chamber, (-PB), for support in approving changes to the law that would allow the PF to request the suspicion or impeachment of authorities in charge of the case.

The request is made days after the Federal Police found quotes from Toffoli on Daniel Vorcaro’s cell phone, which forced the minister to stop reporting on the case.

Even after Toffoli left, court ministers criticized the PF’s progress on their colleague’s actions. This is because today the corporation does not have the power to request suspicion from authorities, as it is not a party to the process. Delegates say the measure is possible.

In the letter sent to the President of the Chamber, the National Association of Federal Police Delegates (ADPF) and the National Federation of Federal Police Delegates (Fenapol) mention the Master case several times.

In one section, the entities reinforce that, in fact, the delegate is not a party, he is exempt and that the action is strictly technical. “Restricting the delegate’s capacity is damaging the independence of those who investigate extremely complex and relevant cases. It is bureaucratizing the fight against crime and creating an obstacle that only favors impunity”, says the letter.

The delegates’ request is a response to criticism, but directly to Toffoli.

On the day that the general director of the PF, Andrei Rodrigues, delivered the report with quotes from Toffoli to the president of the , minister, the minister’s office stated that the Federal Police’s request was based on “inclusions” and was not provided for by law.

Toffoli cited the section of the Civil Procedure Code that does not give the corporation legitimacy to formulate this type of request.

In addition to having the power to request suspicion of authorities, including STF ministers, the entities also want the delegate leading the investigation to be able to appeal any rejections by the authority in charge of the case.

In the Master case, for example, Dias Toffoli denied access to documents and objects seized in . He even ordered that everything be stored at the STF headquarters — then transferred it to the Attorney General’s Office. The delegates appealed to the AGU (Attorney General of the Union), but were unsuccessful.

The entities want changes to two laws: that of criminal organizations and the “Delegate Law”. And they also suggest that the changes be included in the Legal Framework for Organized Crime, which became known as the anti-faction PL and which has already passed through the Senate and is in the Chamber.

The delegates state that the changes will expressly guarantee “debureaucratizing tools for criminal investigation, ensuring the speed and efficiency that Brazilian society demands in combating crime and guaranteeing Public Security”.
