The trial takes place in the First Panel, eight years after the crime.
According to the Supreme Court, there is a structured plan for situations involving major events or processes of broad public interest. In addition to the STF Judicial Police’s own staff, a task force was set up with support from judicial police officers from the Federal District and other bodies.
The teams operate permanently, 24 hours a day, seven days a week. The Court also maintains coordination with the Public Security Secretariat of the Federal District to jointly define the necessary measures.
According to the Court, planning takes into account risk analyses, allowing the adaptation of strategies to guarantee institutional and public safety. Access control was reinforced, with prior sweeps and the use of metal detectors.
The trial
Among the defendants are the brothers Chiquinho Brazão e Domingos Brazãoaccused of ordering the murder. The police chief also responds to the criminal action Rivaldo Barbosaindicated as the intellectual mentor of the attack; the PM major Ronald Paulo Alves Pereirawho would have monitored the councilor’s routine; and the military police Robson Calixto Fonsecawhich would have helped to hide the murder weapon and integrate the group’s financial core.
The session began with the reading of the report by the minister Alexandre de Moraescase rapporteur. Afterwards, the PGR will speak (Attorney General’s Office), who will present arguments to defend the defendants’ request for conviction for criminal organization, qualified homicide and attempted homicide.
Afterwards, a lawyer “assistant to the prosecution” will speak. He was appointed by Fernanda Chaves, Marielle’s former advisor who survived the attack, to help the Public Ministry build the case.
After the arraignment, the defendants’ lawyers will have up to one hour each to defend their clients. Once the demonstrations are over, the ministers go to vote. In addition to Moraes, the First Panel includes ministers Flavio Dino, Cristiano Zanin e Carmen Lucia. At least three votes are needed to form a majority.
