It doesn’t matter whether it’s your private home garden or a recreational plot. Allotment gardeners from RODs are treated particularly harshly – the regulations there are even stricter and a smoking pile of leaves means you can say goodbye to garden membership.

The services have no mercy for “troublemakers”. If the city guard or police notice smoke over your property, you must take into account:
- A fine of up to PLN 500 – issued on the spot.
- A fine of up to PLN 5,000 – if you refuse to accept the ticket and the case goes to court.
But that’s not the end. If the smoke causes a nuisance to neighbors or, worse yet, spreads onto the road and obscures drivers’ visibility, you could be held liable for creating a hazard to land traffic. Then the costs are counted in thousands.
Your neighbor has the right to “clean air”. Don’t risk conflict
Lighting a fire is the shortest way to a neighborly war. Even if you think that “a little smoke never hurts anyone,” your neighbor may have a different opinion. He has the right to defend himself against the so-called immissions, i.e. smell and smoke penetrating his property. In the era of modern technology, one photo sent through the fence to the municipal police is enough for a police car to appear at your gate within 15 minutes.
A clever way to make recipes. A bonfire, yes, but on one condition
Does this mean that roasting sausages is illegal in 2026? Well, no! There is a gateway here that is worth knowing. Burning waste (garbage, leaves, branches) is prohibited, but lighting a recreational bonfire is allowed.
How to do it legally and get rid of unnecessary wood?
Only use dry wood: Humidity must be less than 20%. Such wood does not smoke, but only produces embers.
Keep your distance: The fire must be at least 4 meters from the border of the neighbor’s plot and as much as 100 meters from the forest border!
Recreation, not disposal: The bonfire must be used for social purposes (e.g. roasting potatoes). If you throw wet leaves on them and create a smokescreen, no one will believe in “recreation”.

What to do with branches if you can’t burn them?
If you don’t feel like taking risks with regulations, you have three legal options:
BIO bags: Pack leaves and smaller branches in brown bags – the municipality is obliged to collect them.
Composter: This is the best way to get free fertilizer for your garden.
Shredder: Cutting branches into wood chips is a great mulch for conifers, which also looks beautiful.
Remember: In 2026, officials place great emphasis on ecology. Before you throw a match into a pile of branches, consider whether these few minutes of fire are worth the PLN 5,000 fine.
