Procon-SP fined the company responsible for Shopee for more than R$14.1 million for violations of the Consumer Protection Code, including abusive clauses and information failures. According to the agency, the company has the right to defense.
According to Procon, the infractions were verified based on the investigation of complaints registered with the agency and in clauses considered abusive in the platform’s Terms of Service. Furthermore, the company no longer made essential contact information available on its website, in violation of the Consumer Protection and Defense Code and the legislation that regulates electronic commerce.
According to Procon-SP, digital sales intermediation platforms are part of the supply chain and, therefore, respond jointly for any failures in the provision of services.

The agency reported that the amount of the fine is calculated based on official company information, such as its revenue profile and other criteria provided for by law.
