The legal group Prerrogativas released a note this Saturday (7) criticizing “abuses committed in investigative procedures”.
The collective, aligned with the Lula government, published the position after the leaks of information from the banker’s cell phone and data from the banking and tax secrets of Fábio Luís, son of President Lula.
“Despite recognizing the importance of adequate and necessary investigation of any fraud and not underestimating the relevance of elucidating the conduct and those possibly responsible and involved, including authorities, the Prerogativas group cannot admit the succession of irregularities carried out during the course of these procedures”, says the statement.
In the text, the group compares the leaks to Lava Jato procedures. “The occurrences related to selective leaks of excerpts from the police investigation are absolutely reprehensible and infamous, as well as the vexatious exposure of those investigated, creating an environment of abominable spectacularization of police action that harks back to the ignominious memory of Operation Lava Jato”, follows the note, signed by Marco Aurélio de Carvalho, its coordinator, who informally participates in the defense of the president’s son.

The concern, says the group, is with the exposure of information without context, which harms the right to defense. The confidential information was leaked from the Federal Police and the CPMI of the INSS, which received part of the material.
“The manipulation of police investigation procedures and the execution of precautionary measures, including the deprivation of freedom of the accused, cannot, under any circumstances, violate the fundamental rights guaranteed by the Constitution of the Republic and strictly regulated by applicable law, under penalty of bringing forward the blame and stigmatizing those involved, generating irreparable damage not only to their personal integrity, but also to the credibility of the legal order”, states the statement.
The group also says that Lava Jato’s “unacceptable excesses” should serve as a warning for the PF’s actions.
“There is an urgent need, therefore, to preserve the full guarantees inherent to the presumption of innocence of the accused, ensuring their dignity in complying with any measures determined in the respective process, ensuring, in addition, the secrecy of evidence that may affect the intimacy and privacy rights of the accused, containing the harmful spectacularization of the investigations”, concludes the Prerogativas.
