Regulations regarding tree cutting have aroused emotions among property owners for years. It is worth knowing them, because ignorance can be costly.
March 1st began bird breeding seasonwhich will last until October 15. During this time, cutting down trees and shrubs is significantly limited, even if they grow on private property. In practice, this means that during the breeding season, cutting down a tree requires obtaining an appropriate permit. Simply reporting in advance may not be enough. Breaking the regulations may result in a high fine, and in extreme cases also administrative fine charged at the rates specified in the Nature Protection Act.

The circumference of the trunk measured at a height of 5 cm from the ground is of key importance. It is this parameter that determines whether a permit is needed or whether a notification is enough.
You can remove a tree without the need to obtain a permit (but only after reporting) if its circumference does not exceed:
- 80 cm — in the case of poplars, willows, ash-leaved maple and silver maple,
- 65 cm — in the case of horse-chestnut, black locust and maple-leafed plane tree,
- 50 cm — in the case of other species (e.g. spruce, birch).
After submitting the application, the office has 21 days to carry out an inspection and 14 days for possible objections. If he does not agree, cutting down can be started. However, it is worth remembering that the consent is not indefinite. After expiration 6 months you have to go through the procedure again.

The law provides for several exceptions. Without permission you can remove, among others:
- shrubs growing in clusters up to 25 sq m,
- fruit trees and shrubs (except those growing in areas entered in the register of monuments or in public green areas),
- trees removed to restore land to agricultural use,
- trees broken or overturned by a storm (after prior inspection by the competent authority).
Important: wood harvested as part of reported felling cannot be sold or used in business activities. They can only be used for your own needs.
The amount of the penalty depends on the tree species and its circumference. In some cases it may be even several dozen thousand zlotys. The administrative body has the right to charge a fee at the rates specified in the regulations. One hasty decision can cost much more than the services of a professional gardening company.
