Prerogatives criticizes house arrest for Bolsonaro – 03/23/2026 – Panel

The legal group Prerogativas, aligned with the Lula government, says in a statement that granting house arrest to the former president would be selectively applying the law.

“Prerogativas defends the application of the law without selectivity, for Chico and Francisco. If Bolsonaro has the right to be transferred to home care, before that the right also applies to poor, black and peripheral defendants who are in similar or even worse situations”, says the group’s coordinator, Marco Aurélio de Carvalho.

The issue generated controversy in the group, after the publication of an article that has lawyer Roberto Podval, one of its members, as co-author. The text defends Bolsonaro’s house arrest for “a matter of humanity”.

According to Carvalho, the former president had rights in prison that do not benefit the majority of inmates. “Bolsonaro stayed in a 60 square meter cell, he had all the medical care. Care that Brazilian prisoners generally don’t have”, he states.

The group’s coordinator also states that the decision to give the benefit to Bolsonaro is dangerous for Brazilian institutions. “What perhaps the Attorney General’s Office and the Supreme Court haven’t realized is that they are creating an alligator in the bathtub. If they turn around, we don’t know what could happen.”

He also says that the issue is a chance for the Judiciary to demonstrate independence. “This case is an opportunity to show neutrality, its counter-majoritarian vocation, which will not allow itself to be pressured by public opinion or by groups or hordes.”
