STF ministers received funds above the ceiling – 03/22/2026 – Politics

Six of the 10 ministers of the (Federal Supreme Court) received funds above the civil service salary ceiling while they already held positions at the court, which is now the scene of decisions against the payment of .

Among those who pocketed amounts above the constitutional ceiling, currently R$46,300, are and , authors of injunctions that blocked super salaries in federal, state and municipal public administration.

Ministers , , and . Since 2019, the additional payments received by ministers have reached R$2.8 million, in current values.

A Sheet carried out the survey using databases from the Judiciary, the Federal Attorney’s Office and the Attorney General’s Office, which pays its members succumbing fees — remuneration received by lawyers from the winning party in a judicial process and which, in public administration, are compared to a type of bonus for career civil servants.

Moraes was the one who received the highest amounts throughout the period analyzed. The minister, who worked as a prosecutor from 1991 to 2002, received a total of more than R$1 million net from the MP-SP (Public Ministry of the State of ) from 2019 to 2026.

The ministers were contacted by email and telephone via the press office, but did not respond to the report’s questions.

The minister and the president of the court, , were state attorneys, and the Union’s attorney general. The report did not identify any frills paid to ministers during the period analyzed. He was never a public servant, so he would not be entitled to these additional benefits.

Ministers received super salaries due to retroactive earnings, one of the main frills that fatten magistrates’ paychecks. They are known among civil servants as “puxadinhos”: the bodies create some additional benefit to be paid to their members and adopt the understanding that it goes back to a certain date in the past, generating invoices worth thousands of reais owed to a single civil servant.

In February, a Dino injunction barred funds paid above the constitutional ceiling and prohibited new laws that created hardships. Another decision in the STF, this one by Gilmar Mendes, suspended the restrictions provided for in state laws for members of the Judiciary and the .

Dino received amounts above the ceiling already in his position at the Supreme Court. In December 2024, the minister, linked to the TRF-1 (Federal Regional Court of the 1st Region), earned almost R$30,000 net just in amounts referring to retroactive funds — referring to rights not enjoyed while he was still a federal judge, such as vacations and days off — in addition to his salary. In other words, that month, Dino received R$55 thousand net, in addition to his remuneration of R$24.6 thousand as a member of the STF.

Furthermore, the minister received super salaries while he was still governor of Maranhão. In December 2020, it earned R$106 thousand net, also due to retroactive payments.

The dean of the court, Gilmar Mendes, pocketed more than R$880,000 paid by the MPF (Federal Public Ministry) since 2019.

The minister served as public prosecutor from 1985 to 1988. He was then transferred to other bodies, but remained linked to the MPF until 2002. At the end of February, Gilmar released, for 45 days, the payment of retroactive payments recognized administratively and already scheduled for the period. The final judgment on the matter, to deal with the injunctions of Dino and the dean of the STF, should take place next Wednesday (25).

In November 2020, the same month in which he took office as minister of the STF, Kassio Nunes Marques also received more than R$277,000 from the TRF-1, where he was a second instance federal judge.

Mendonça, in turn, was appointed minister of the STF in December 2021. Even so, he received R$175.3 thousand, in nominal values, since January 2022. The largest amount was paid in January 2025, when the minister received R$154.8 thousand in retroactive fees, according to data from the Transparency Portal.

Moraes, who received the highest amounts in the period analyzed, is today the rapporteur of two appeals being processed at the Supreme Court regarding symmetry between the Public Ministry and the Judiciary.

At the beginning of the month, Moraes ordered the Regional Federal and Labor Courts and the Courts of Justice in the country to report the amounts paid for equivalent to the Public Prosecutor’s Office or another career in the last ten years.
