The reassessment of the health situation of (PL) to maintain humanitarian house arrest, determined by the minister of the (Supreme Federal Court) on Tuesday (24), was the target of criticism from the defense of the former president and the senator (PL-RJ).
Moraes understood that Bolsonaro’s condition, who has been hospitalized since the 13th, after being diagnosed with aspiration bronchopneumonia, justified serving his sentence at home. The former president left the ICU (Intensive Care Unit) on Monday (23) night, but is still not expected to be discharged.
The decision that granted the humanitarian measure was criticized in part by one of Bolsonaro’s lawyers, criminal lawyer Paulo Cunha Bueno. For him, the temporary nature of the measure, which will be reevaluated within 90 days, is “singularly innovative”. Medical care is, according to Bueno, permanent and “demanded for life”.

Periodic reevaluation has already been used by Moraes in granting other humanitarian house arrests. A predicted precedent occurred in the case of Jorge Picciani, former president of the Legislative Assembly of Rio de Janeiro, which provided for a medical reevaluation every two months.
