Moraes restricts Coaf data sharing

Requests must specify the name of the natural or legal person

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), decided this Friday (27) to establish restrictions on the sharing of financial data from the Financial Activities Control Council (Coaf).

The measure will be applied to requests to send information requested by court decisions and Parliamentary Commissions of Inquiry (CPI).

According to the decision, the transfer of financial intelligence reports (RIFs) can only be carried out by Coaf through formal criminal investigations, the criminal investigative procedure (PIC) of the Public Ministry and administrative processes.

Requests must specify the name of the natural or legal person formally investigated by police authorities, in addition to being related to the object of the investigation.

Moraes also prohibited the sharing of Coaf data in investigative investigations that are not criminal in nature.

The minister’s decision was made in a process that questions the legality of transferring Coaf’s financial data without judicial authorization.

Annulment

The minister’s decision also opens a loophole for the cancellation of shares that have already been made and did not follow the rules defined today.

“The absence of strict compliance with the requirements set out in this decision removes the constitutional legitimacy of the use of information and financial intelligence reports (RIFs), including those already provided and attached to investigations and processes, and constitutes the illegality of the evidence produced”, decided the minister.
