The president of -SP (Brazilian Bar Association, São Paulo Section), Leonardo Sica, stated this Monday (6) that there are already enough elements for ministers of the (Supreme Federal Court) to be with the .
“All I know is from the news, and I think the news deserves investigations, yes. We have to point to the Attorney General’s Office, which is silent,” said Sica.
According to the lawyer, the Federal Council of the OAB is in contact with to take this agenda forward. As shown by Sheetthe magistrates and the former banker press for the facts to be investigated.
“The best situation for those under suspicion is to have an investigation, because it allows you to escape suspicion, it allows you to filter suspicion. If there are suspicions, the best solution that our democracy knows is investigation”, said Sica, who is a criminalist.
“Also because there will be things that are not proven, that are proven, that are not quite like that. Now, when there is no investigation, we are left with assumptions, based on the facts. We know the facts, but people have to explain themselves.”
Asked who he was referring to, the president of OAB-SP stated that he did not want to personalize it. “I’m not talking about people. Having people under suspicion doesn’t worry me. It worries me to have an institution under suspicion.”
“I think facts need to be investigated. Ministers receive rides on private jets. We have to extensively investigate this, broadly investigate each and every one. Especially because, based on what you’ve been reporting… I really don’t want to personalize, otherwise we won’t face the problem.”
The statement was given to journalists at the OAB-SP headquarters, in the center of the capital of São Paulo, where an event promoted by the entity is taking place to debate the Judiciary.
Regarding the code of ethics, Sica stated that he will talk to minister Cármen Lúcia, rapporteur of the proposal at the Supreme Court, and that he hopes that a project will come to fruition, although not exactly along the lines outlined by the OAB-SP.
The São Paulo section of the Order is one of the frontline defenders of a code of conduct for STF ministers. In January, for greater transparency, restrictions on conflicts of interest and rules for quarantine after leaving office.
An alternative studied by the institution is to present a draft code of conduct directly to the (National Council of Justice) to which the STF is not subordinate.
“The National Council of Justice can adopt a code of conduct that applies to all judges, except the Federal Supreme Court. However, we believe that by doing this we create a more favorable or more difficult environment to maintain resistance [internas no STF].”
