The proposal by (Supreme Federal Court) generated a reaction from two of the main spokespeople on the left and right in the political debate.
(-RN), leader of the opposition in the Senate and head of the (PL-RJ) pre-campaign for the Presidency, questioned what the convergence between the minister’s statement and recent positions from the . The pre-candidate for the Senate and former minister of the government’s Institutional Relations Secretariat (PT), praised the initiative.
This Monday (20), Flávio Dino published an article on the ICL Notícias portal, in which he spoke in favor of reform in the Judiciary.
Dino defended the idea that the STF has suffered greater scrutiny for getting involved in issues such as climate denialism and defending democracy. He also spoke about the need for robust changes to the Justice System, beyond “superficial changes, based on easy slogans, or of a purely retaliatory nature”.
Finally, he proposed 15 “axes for this normative redesign”, among them the review of the chapter of the Penal Code on crimes against the Administration of Justice and the review of the constitutional powers of the Superior Courts.
Gleisi Hoffmann classified the magistrate’s article as “very good”. She reinforced the perspective that criticism against the STF would be growing after decisions on topics such as the January 8 coup attempt.
“Strengthening the justice system so that the rights of all Brazilians are enforced quickly and reliably, this must be the objective of a reform in the Judiciary, as Minister Dino rightly said ‘Brazil needs more Justice, not less'”, stated Hoffmann.
On the other side, the leader of the opposition in the Senate, Rogério Marinho (PL-RN), criticized the convergence between Dino’s article and the PT’s proposals on the topic. Figures such as the national president of the party, Edinho Silva, have defended the , including the Judiciary, to bring society closer to the State.
The theme also appears in the PT’s new political program, which defends the creation of a conduct manual for the Supreme Court, . The text must be approved at a party congress scheduled to take place between April 24th and 26th, in Brasília.
According to Rogério Marinho, “the convergence between minister Flávio Dino’s article and the Workers’ Party’s defense of judicial reform on the same day raises legitimate doubts about the conduct of this debate.”
The head of Flávio Bolsonaro’s presidential campaign stated on social media that he considered reform of the Judiciary necessary, but said that “it is up to the Legislative Branch to lead this process.”
He cited what he classified as “central themes” still ignored in the discussion, such as the recurring use of monocratic decisions and the role of relatives of ministers in processes that could be judged by them.
“It is equally necessary for the Federal Supreme Court to restore its original role as a constitutional court, including reviewing those authorized to propose actions, avoiding the trivialization of its actions and the transformation of the Court into a permanent investigation body, with endless investigations initiated ex officio, in deviation from its institutional function”, stated Marinho.
“Without addressing these points, any reform proposal runs the risk of being just a convenient adjustment, and not a real change in the service of Justice and society.”
