According to the Order of Certified Public Accountants, declarations for 2023 and 2024 can be replaced until June 30, 2026. This allows taxpayers to review the tax framework and, if they meet the requirements, activate the missing benefit.

Submitting a replacement declaration generally involves paying a fine, normally set at around 25 euros.

For older years, the process becomes more complicated

When it comes to income for 2021 and 2022, the scenario changes. In these cases, the deadline for submitting replacement declarations has already passed, which prevents a direct correction using the usual model.

The only option available is to submit a request for review of the tax act, through the Finance Portal.

This mechanism allows you to request a reassessment of the situation, but it depends on the decision of the Tax Authority. In other words, there is no guarantee that the request will be accepted, each case being analyzed individually.

The possibility of review is provided for in Brazilian tax legislation, but requires adequate justification and compliance with specific deadlines. In practice, the taxpayer has to demonstrate that there was a material error in the collection of the tax, which is not always simple.

Given this scenario, the recommendation is to carefully review the statements submitted in recent years. Confirming whether you were able to benefit from this regime and whether it was correctly applied can make the difference between recovering a significant amount or losing this right permanently.
