Text from the Lula government will regulate PEC at the end of the 6 X 1 scale

Planalto Bill will define transition, collective agreements and rules for sectors after constitutional change

The president’s government (PT) wants to use the bill to regulate the PEC (Proposed Amendment to the Constitution) that reduces working hours and abolishes the 6 x 1 scale. The proposal will be used to detail transition rules and specificities of each professional category.

This Wednesday (May 13, 2026) between the Palácio do Planalto and the president of the Chamber, (Republicanos-PB).

The PEC establishes the general guidelines for the change: maximum working hours of 40 hours per week, maintenance of salaries and guarantee of 2 days off per week.

According to the Minister of Labor and Employment, the Constitution does not allow detailing all the rules necessary to implement the new journey.

“Adjusting the journey doesn’t just apply to the PEC”stated the minister. According to him, the constitutional text will only deal with “general conditions” of change.

The bill will be responsible for infraconstitutional regulation. The text must define transition rules, parameters for collective negotiations and differences applicable to sectors of the economy.

Marinho stated that part of the definitions will be delegated to collective agreements. He also said that ordinary legislation cannot provide for all the specificities of “microsetores” of the economy.

The government assesses that the processing of the PEC and the bill must occur in parallel. The expectation is to first approve the constitutional amendment and then complete the regulation.

The PEC is already being processed in a special committee of the Chamber and should reach the plenary in May. According to Marinho, it will be up to Motta to decide whether the project will be analyzed by the Work Committee or by a specific panel.

Planalto admits to presenting a new bill if the Chamber deems it necessary during processing. The basis of the regulation, however, must be the text already sent by the Executive to Congress.
