The minister of the (Federal Supreme Court) asked her to explain the periods in which she was without a GPS signal. Known as “Débora do Batom”, she is under house arrest and with an electronic ankle bracelet due to her conviction in the coup acts of January 8, 2023.

The rapporteur asked the hairdresser’s defense for information about non-compliance with monitoring conditions at the end of April. On May 1, her lawyers responded that there had been no escape attempt.

She was sentenced to 14 years in prison for the crimes of attempted violent abolition of , coup d’état, damage to listed property, qualified damage with violence and armed criminal association.

Signal absences were recorded between April 20th and 26th and then between April 27th and May 3rd.

Débora since last year.

“The records of absence of GPS signal, mentioned in the case file, do not indicate any attempt at evasion or deliberate non-compliance with the imposed conditions. Such occurrences arise, with high probability, from technical failures inherent to the electronic monitoring system, and are not capable of characterizing disciplinary misconduct”, said the defense.

“The prisoner remained at her residence, without any concrete element that demonstrated a violation of the established conditions.

After the first explanations, new reports of signal absences were sent to the authorities, between April 27th and May 3rd.

Last Tuesday (12), the Attorney General of the Republic, Paulo Gonet, spoke out, at Moraes’ request.

“The nature and characteristics of the records, lasting a few minutes, for several days in a row, are compatible with the justifications presented. However, as there is no official information from CECOP [Centro de Controle e Operações Penitenciárias] regarding the verisimilitude of the allegations, it is recommended that the situation be certified”, he said.

Débora has also been asking for a review of her sentence in light of the one approved by the — which could reduce the sentences of the former president () and others and for the attacks.

Last Sunday (10) Moraes applied to her the understanding that suspended the application of the law until the court’s plenary judgment on the constitutionality of the measure, which has now become .

The actions that question the law were drawn on Friday night (8) to Moraes himself. Therefore, in addition to reporting cases related to the coup plot and attacks on the headquarters of the three Powers, it will conduct actions on the size of penalties for crimes related to the cases.

Also on Saturday, the defense of Débora and other convicts said that Moraes’ decision causes “huge legal and institutional concern”.

“The National Congress approved a law. The law was enacted. The law was published. The law is in force. And even so, it is no longer applied by an individual decision based on a bureaucratic suspension until future judgment of actions in the Supreme Court”, says a note from lawyer Hélio Garcia Ortiz Junior.

“Instead of allowing the immediate application of a more beneficial criminal law — something historically guaranteed by the Brazilian legal system — it was decided to prevent its effects even before a definitive decision by the plenary”, he adds.

The hairdresser participated in the 8/1 attacks and became known for spraying lipstick on a statue in front of the STF, with the phrase “lost, idiot”. She was sentenced to 14 years in prison for the crimes of attempted violent abolition of , coup d’état, damage to listed property, qualified damage with violence and armed criminal association.
