Monark’s defense says that the “non-standard” change in the MP-SP took place after a favorable opinion to the influencer
In April 2026, a change in the MP-SP (Public Ministry of São Paulo) altered the action filed against influencer Bruno Monteiro Aiub, known as Monark. After a prosecutor asked for the case to be archived, another member of the body took over the case and again defended Monark’s sentence to pay R$4 million for collective moral damages.
The case took place at the 2nd Public Prosecutor’s Office for Human Rights in the Capital, the sector of the MP-SP responsible for actions related to human rights and collective interests. This is how the case opened against Monark is framed. In February 2022, the former presenter of Flow Podcast During the program, he defended the existence of a legalized Nazi party in Brazil.
On March 31, prosecutor Marcelo Otavio Camargo Ramos presented a favorable opinion to the influencer. In the document, he stated that Monark’s statements constituted a defense “abstract” of freedom of expression and not condoning Nazism. Therefore, he asked for the civil action to be dismissed, according to Monark’s defense.
One day earlier, on March 30, an ordinance published in the Official Gazette determined that Marcelo Otavio would remain in the prosecutor’s office until April 30. In the following days, however, the designation was changed. First, the scale was reduced to part of the month. Then, on April 8, the then acting Attorney General of Justice, Plínio Antônio Britto Gentil, canceled the prosecutor’s stay in office.
With the change, the case passed to prosecutor Ricardo Manuel Castro, who was already working in the prosecutor’s office in the first half of April. On April 15, Castro presented a new statement asking the Court to disregard the previous opinion and resume the request to sentence Monark to pay R$4 million.
In the petition, the prosecutor argued that defending the creation of a Nazi party represents the legitimization of the persecution and extermination of minorities, including Jews, LGBTQIA+ people and vulnerable groups.
Officially, the MP-SP reported that the prosecutor’s office was without a head after the promotion of the former person responsible to the position of prosecutor and stated that the changes occurred due to internal administrative criteria. According to the organization, Marcelo Otavio had been designated to work in the 2nd half of March and the 2nd half of April, while Ricardo Manuel Castro was already scheduled for the 1st half of the month. The April appointment, however, was later suspended.
Monark’s defense, however, questions the exchange. The lawyers claim that Marcelo Otavio was already scheduled to work throughout the month of April and maintain that the change allowed another member of the Public Ministry to reverse the previous position within the same process.
To the Poder360lawyer Hugo Freitas stated that the change occurred after the statement in favor of the influencer and classified the change as outside the standard adopted by the body in temporary appointments.
The defense filed a disciplinary complaint with the Superior Council of the Public Ministry against Plínio Gentil. Lawyers claim possible “deviation of purpose” in changing the designations and state that the new manifestation would violate the principle of the natural prosecutor and the so-called consummative estoppel, a rule that prevents the review of an already completed procedural act.
A legal opinion attached to the case reinforces the defense’s thesis. The document, signed by jurists Luiz Guilherme Marinoni and Ricardo Alexandre da Silva, maintains that the Public Ministry could not present a new statement in the opposite direction without new relevant facts. CASE HISTORY
Monark became the target of after the declaration in Flow Podcast. The repercussion led to the breaking of commercial contracts, the loss of sponsors and the influencer’s departure from the program.
In March 2024, the MP-SP filed a public civil action asking for compensation of R$4 million for the influencer’s statements.
In addition to the legal dispute, Monark also faced blocks on digital platforms. On May 1, 2026, the the channel “Bruno Aiub Show”created to mark his return to the platform after almost 3 years away. According to the profile contained only 1 video presenting the studio prepared for future interviews.
The lawyer stated that the channel was taken down under a general allegation of violating community guidelines. After the removal, Monark reported having filed an administrative appeal with YouTube and classified the profile’s deletion as “disproportionate”.
