Decree on Marco Civil gives superpower to Jorge Messias – 05/25/2026 – Panel

The decree issued by the president that regulates the rules on the new law gives superpower to the Union’s attorney general, whose name was barred by the Senate from a vacancy in the (Supreme Federal Court).

The decree (National Data Protection Agency) to monitor the platforms’ duties, including content moderation, and also says that it will notify companies when advertising is related to public policies.

In practice, Messias must activate the platforms, with possible removal of content, when he understands that there is misleading, abusive or fraudulent advertising about government public policies.

The measure is seen as a “superpower” for Messiah for two reasons. One of them is that politicians who eventually promote content on social media can be directly targeted by the Union’s attorney general.

Furthermore, in the political world, the fear is that with regulation via decree, the government will have more powers than the National Congress itself and remove content in a discretionary manner.
