The Court of Justice rejected requests made by the Public Prosecutor’s Office in which they aimed to restrict the overt actions of the deputy mayor towards the homeless population, especially in the region.
The decision was made by Nandra Martins Da Silva Machado, from the 5th Public Finance Court, and published on the 8th.
In this public civil action, the Public Prosecutor’s Office asked, as a preliminary injunction, that Mello Araújo refrain from participating in coercive actions, as well as the prohibition of police or official operations in social assistance facilities —except with the support of a court order or in a flagrant situation— and the use of physical force and lethal weapons.
According to the Public Ministry, members of the Military Police and GCM have carried out approaches with disproportionate use of physical force, seized property from homeless residents without opening an administrative procedure for restitution, and carried out raids on social assistance entities alongside the vice-mayor.
The mayor’s management () argued, in the action, that actions in social assistance facilities occur exclusively to protect public agents and presented protocols that regulate the approach and seizure of assets.
The city hall also says that operations in the region are carried out by the Military Police, which is subordinate to the Government of São Paulo, and not by the Municipal Guard.
The public civil action was proposed by the prosecutor in March this year.

“He’s an idiot from the Public Ministry who keeps creating situations to defend his party’s ideological issue, and not the defense of the public interest,” said Nunes.
