The (Attorney General’s Office) denounced seven people this Wednesday (27) in the investigation under judicial proceedings at the (Superior Court of Justice).
Among those reported are the lobbyist and his wife, Mirian Gonçalves. Also denounced were Márcio José Toledo Pinto, a former STJ employee who worked in several offices, and Daimler Campos, the former chief of staff of minister Isabel Gallotti.
This is the first complaint in the investigation, which began in 2024 and deals with suspicions related to the second most important court in the country.
Andreson was charged with crimes of active corruption, exploitation of prestige, money laundering and being part of a criminal organization. He is under house arrest in Mato Grosso.
The lobbyist is appointed by the PGR as the “main axis of intermediation” between those interested in purchasing decisions and courts based in Brasília.
“It was his responsibility to establish a connection between interested third parties, generally lawyers, responsible for communicating with beneficiary clients, and advisors to judges and ministers with access to or influence over judicial pronouncements, especially in the Superior Court of Justice”, says the complaint.
Daimler and Márcio Toledo are accused of committing passive corruption, violating confidentiality and also participating in a criminal organization. Toledo is also charged with the crime of money laundering.
Gallotti’s former chief of staff has been away since the investigations began. Despite the complaint, he had not been. Toledo was dismissed from the court after an administrative investigation.
When contacted, the defenses deny irregularities and state that they trust the Court’s analysis of the case.
According to the Attorney General of the Republic, the group integrated “in a free, conscious, voluntary, stable, structured and division of tasks, in a unity of design, a criminal organization established since at least June 17, 2019 and operating until December 5, 2023”.
This organization, he said, was “aimed at paying and obtaining illicit pecuniary advantages, in exchange for interfering in the outcome of judicial decisions handed down in the context of cases being processed at the Superior Court of Justice, through public servant competition, with the criminal organization taking advantage of this condition to commit a criminal offense.”
There are no ministers denounced by the PGR, and it states that the actions of former cabinet assistants “in addition to that of others whose participation is still in the in-depth investigative phase, compromised the soundness of judicial pronouncements made by ministers Nancy Andrighi and Maria Isabel Gallotti and by Minister Moura Ribeiro”.
For Gonet, the role of the accused employees was to provide “access to draft decisions registered in the court’s internal system, guide and, on certain occasions, prepare texts aligned with the organization’s intended result, in addition to passing on procedural information protected by confidentiality to other members”.
When contacted, Daimler’s lawyers, Bernardo Fenelon and Lucas Fraga, said that “the complaint is teratological”.
“It is enough to verify that the investigation promoted by the STJ had removed his responsibility and the delegate responsible for the case did not indict him. Unfortunately, all the defensive documentation presented was ignored.”
“We firmly believe that the Judiciary will bring justice and promptly reject the accusation,” the lawyers said.
Andreson and Mirian’s defense states that “after two years the complaint was filed, confirming, once again, the absolute incompetence of the [Supremo Tribunal Federal] to appreciate the facts. He is not and has never been competent for the case.”
“Now from now on, the defense will only speak out in the process, as is appropriate in the Justice system,” said lawyer Eugênio Pacelli, in a statement.
When contacted, Márcio Toledo’s defense did not respond.
The others accused are Márcio Toledo’s wife and two accused of being financial operators.
The rapporteur of the investigations into the operation on sales of decisions is the minister, of the STF, who will analyze the case. To be accepted, the complaint must go through the First Panel of the Supreme Court.
The investigations began after analyzing the cell phone of lawyer Roberto Zampieri, who died in 2023, in Cuiabá, in front of his office in the capital of Mato Grosso.
On his cell phone, conversations were found with judges, businessmen and Andreson.
