CNN commentators Vinicius Poet e José Eduardo Cardozo debated, on Monday (8), in The Great Debate (Monday to Friday, at 11pm), about “what will be the impact if Vorcaro’s plea is rejected?”
The PF (Federal Police) has considered the content of Daniel Vorcaro, from Banco Master, as insufficient. Although the businessman has expanded the topics for the sentence reduction agreement, sources indicate that he has not advanced details relevant to the investigation.
The lack of effective collaboration has led members of the PF to argue that the new agreement be rejected.
Vorcaro had signaled that he would bring , both in relation to the financing of , and in relation to Banco Master’s relations with PT da Bahia.
However, to date, the businessman has not revealed any new information or concrete details. The corporation is expected to decide on the validity of the agreement this week.
Impact for the whistleblower
For Poit, the consequences would be negative mainly for Vorcaro himself. “Negative impact for Vorcaro himself. As time passes, he may even present a third, a fourth proposal, but he will lose credibility in his proposals and his speech”, he stated.
Poit added that the businessman also runs the risk of losing the opportunity to reveal information that the PF itself can discover independently, making its collaboration unnecessary.
Poit also highlighted that Brazilian legislation requires that a plea bargain generates a useful result. “You need to identify authors and participants, you need to reveal the structure of the organization, you need to prevent new crimes, recover money or some asset that was stolen”, he explained.
In the commentator’s assessment, the situation is bad for both Vorcaro and the country. “Bad for Brazil, which always has that suspicion hovering over many big people in the Republic,” he said.
Legal analysis of the case
Cardozo agreed with Poit’s assessment and added that every whistleblower has the march of time against him. “If the investigations are faster than the revelations he can make, this accusation cannot be made,” he stated.
For Cardozo, Vorcaro would not be instructing his lawyers to present a complete statement. “It seems to me that Vorcaro has not been happy. He has not been instructing his lawyers to make a statement with everything he has,” said the commentator.
Cardozo also highlighted that a statement needs to be accompanied by corroborating evidence, and not just narratives. “The whistleblower has to bring facts and evidence. By bringing facts and evidence that are no longer necessary, he is unnecessary”, he explained.
According to him, if Vorcaro insists on presenting an incomplete proposal, the legal consequences could be severe.
