Nunes Marques denies request to stop screening of the film ‘Dark Horse’ during elections

The president of the Superior Electoral Court (TSE), minister Kassio Nunes Marques, rejected this Friday (12) an action that sought to prevent the release of Dark Horse, a film inspired by the political trajectory of former president Jair Bolsonaro (PL).

The representation was presented by federal deputy Rogério Correia (PT-MG) and by members of the Prerogatives Group. The authors argued that the production could influence the 2026 presidential race by politically favoring senator Flávio Bolsonaro (PL-RJ), pre-candidate for Palácio do Planalto.

The decision, however, did not analyze the arguments related to the film’s content or its possible electoral repercussions. Nunes Marques closed the case by concluding that the authors of the action do not have procedural legitimacy to present this type of question before the Electoral Court.

Understanding the TSE

According to the President of the Court, electoral jurisprudence requires that actions aimed at propaganda or the potential electoral benefit of a candidate be proposed by people running for election in the same district as the person represented.

As Flávio Bolsonaro is nominated as a pre-candidate for the Presidency of the Republic, a position of national scope, Rogério Correia would not meet the requirement. The congressman is a federal deputy for Minas Gerais and intends to run for re-election in the state.

What questioned the action

The authors stated that the film’s release, scheduled for September, would take place close to the first round of the general elections, scheduled for October.

In the evaluation of the signatories, the proximity between the launch and the electoral campaign would increase the potential impact of the work through exhibitions in cinemas, digital platforms, social networks and promotional actions.

The petition also raised doubts about the financing of the project and cited the participation of businessman Daniel Vorcaro, founder of Banco Master.

With the rejection of the action, there is, at this moment, no determination from the Electoral Court that would prevent the distribution or exhibition of Dark Horse.
