What is self-declaration of illness

Self-declaration of illness allows the worker to justify up to three consecutive days of absence for health reasons, without needing to go to the health center or hospital to obtain sick leave.

In practice, the worker declares that he is unable to work due to illness and this absence is justified within the established limits.

Despite this, the recommendation is to act with caution. If the worker recovered and only needed to justify Friday, he must communicate his early return. The Directorate-General for Health and SNS 24 allow the user to assess their health status and declare their return to work before the end of the three days, if they have recovered.

The situation changes for those who work on the weekend

The answer may be different if the worker has a schedule that includes Saturday or Sunday. Anyone who works shifts, on rotating days off or in sectors that work on weekends must analyze the situation according to their specific schedule.

If Saturday or Sunday are normal working days, then they may be covered by self-declaration as days of absence. In this case, we are no longer dealing with days of weekly rest, but rather days in which there was an obligation to work.

What to keep

The worker must keep proof of self-declaration, the communication sent to the employer and, if applicable, the record of the early return made in Previdência Direta. If the company discounts Saturday and Sunday despite them being rest days, the worker must request written clarification and request an indication of the legal basis for this discount. Having everything documented is important to resolve the situation internally or, if necessary, ask for support from the competent authorities.

The practical answer

If the self-declaration of illness is issued on Friday and the employee has Saturday and Sunday as weekly rest days, the company must not deduct these days from their salary. Even so, if the worker recovers before the end of the three days, it is advisable to communicate the early return with effect from Saturday.

In simple terms, the system can count three consecutive days, but the salary must respect the actual working hours. If there was no obligation to work on the weekend, there is no absence from work on those days.
