The conviction of the former deputy (-SP) by the (Supreme Federal Court) this Tuesday (16) is another sign of what they see as persecution by the court.
Among PT members, the decision strengthened the discourse of national sovereignty. This should be one of the main campaign themes of the president (), who will seek re-election in October.
Eduardo was before the First Panel of the STF for the crime of coercion during the process, on charges of having organized an attempt to intimidate the United States against the Brazilian Judiciary with the aim of preventing the trial of the coup plot — in which his father, (PL), was convicted.
The senator (PL-RJ), pre-candidate for the Presidency of the Republic and Eduardo’s brother, stated that the process is null and void and a great injustice and criticized the minister — one of the targets of the Magnitsky Law applied by the USA.
“Alexandre de Moraes should declare himself banned, since in theory he is the victim. […] It clearly seems like revenge, a personal matter. […] We are not living in full democracy”, said Flávio on social media.
The senator also stated that Eduardo should not have been judged by the STF, as he is no longer a federal deputy and lost his forum prerogative due to his role.
Coordinator of Flávio’s pre-campaign, the leader of the PL in the Senate, Rogério Marinho (RN), stated that it is not acceptable for the Judiciary to adopt different criteria depending on the accused.
“During Lula’s arrest, PT leaders turned to international organizations and promoted campaigns abroad against Brazilian court decisions. At the time, such initiatives were treated as a legitimate exercise of freedom of expression and political action,” he says.
“In a democracy, it is legitimate to question state decisions and resort to international bodies to denounce what is understood as abuse or violation of rights. What is not legitimate is to adopt different criteria depending on the political position of those who speak out”, he adds.
The federal deputy (PL-MG) stated that there are two standards. “PT parliamentarians sought international support against Dilma’s impeachment [Rousseff] and nothing was done. Two weights, two measures. Our Justice is anything but impartial”, he published.
Members of Lula’s party took advantage of the occasion to call Bolsonaro’s son a traitor to the country. The group tries to stick this label on Flávio. “Jail for the traitor to the country,” the deputy (PT-RJ) wrote on social media.
“Great day! The traitor to the country, Calabar, Eduardo Bolsonaro’s Silvério dos Reis has just been condemned for exactly that: betraying Brazil”, declared deputy Carlos Zarattini (PT-SP). “Very good STF, congratulations. Now we want him to be deported to Brazil and serve his sentence.”
The PT’s communications secretary, Éden Valadares, said: “Do you know what happens to anyone who is an accomplice in a coup, plots against our sovereignty and tries to coerce Brazilian institutions? 4 years and 2 months in prison, ineligibility for 8 years and loss of public office.”
Eduardo Bolsonaro revoked by decision of the majority of members of the Board of Directors of the Chamber, chaired by (-PB), in December. The decision was made due to excessive absences from House sessions in the last year.
Eduardo’s conviction is still subject to appeal in the STF itself.
After the publication of the ruling, the defense can file a motion for clarification (which aims to clarify any obscurity in the sentence).
As Eduardo is in the USA, the Brazilian government can ask for him to be included on Interpol’s wanted list.
The former deputy is ineligible and, in this case, there is no need for a final judgment because the decision was made by a collegial body. The Supreme Court ordered immediate notification from the TSE (Superior Electoral Court).
