Minister Gilmar Mendes, of the Federal Supreme Court, released this Wednesday the processing of the processes regarding “pejotização” in the first and second degree. The actions had been suspended since April last year, until the highest court ruled on the issue, but the dean understood that the measure generated a “significant backlog” in cases that were still under investigation or pending judgment.
Thus, the release only applies to lower courts, to allow actions to be properly investigated and judged by first-instance judges and Regional Labor Courts. The suspension comes into effect again after the second-degree cases are judged. From this stage onwards, the cases will remain on hold until the STF’s judgment on “pejotização”.
