STJ keeps Rogério de Andrade in federal prison in Rio de Janeiro

The Superior Court of Justice (STJ) determined that the bookkeeper Rogério de Andrade must remain imprisoned in the federal penitentiary system.

The decision took place this Wednesday (24), jointly with the Deputy Attorney General’s Office for Constitutional Appeals, through the Criminal Constitutional Appeals Office.

Rogério was charged by the Public Ministry of the State of Rio de Janeiro (MPRJ) for the qualified homicide of which took place in November 2020, in the parking lot of a heliport in Recreio dos Bandeirantes.

The victim would have been executed after returning from her beach house in Angra dos Reison Costa Verde. Son-in-law of Castor de Andrade, also a criminal, Iggnácio was allegedly killed on the orders of Rogério de Andrade, Castor’s nephew.

In the new decision, the STJ minister, Rogerio Schietti Cruz, granted precautionary relief, attributing suspensive effect to the special appeal filed by MPRJsuspending the effects of the Court of Justice (TJRJ) ruling that had removed the Differentiated Disciplinary Regime (RDD) and ordered the return of the offender to the state prison system.

Still in the decision, the rapporteur recognized, in a preliminary analysis, that, the persistence of the grounds that determined his transfer out of the state was sufficient.

The minister also highlighted the existence of elements indicative of the permanence of the dangerous situation, notably the leadership position in a criminal organization, with influence on the prison system and public security bodies, in addition to the risk to public order and criminal investigation.

A CNN Brazil tries to locate Rogério de Andrade’s defense. The state Court of Justice was also contacted. The space remains open.
