Midfielder Miguelito, from América-MG, was arrested in the act in Ponta Grossa, Paraná, after a case of racial injury in the game between Coelho and Operário-PR, for Serie B of the Brazilian Championship, this Sunday (04/05). Miguelito was arrested in the act declared after the Civil Police of Paraná took testimonials from Miguelito, Allano, and midfielder Jacy, also from Operário-PR, who acted as a witness. The athletes were heard after the end of the match.

The fact occurred in the first half. Shortly after curse, Allano and Jacy ran toward the referee to denounce the fact. The referee made the gesture of X with his arms, present in the CBF and FIFA Anti -Racist Protocol. The match was paralyzed for 15 minutes, but there was no sports punishment. Miguelito was still replaced in the game break.

Operário-PR let go of official note stating that the club “will provide all support to the Allano player and regrets the continuity of the match without modifications, as the protocol has been fired, and is looking for clear images that confirm the allegation.”

Why was Miguelito arrested in the act?

According to the Code of Criminal Procedure, the blatant occurs when the plaintiff is “persecuted, soon after, by the authority, the offended or anyone, in a situation that presumes to be the perpetrator of the infraction.”

Miguelito’s case fits as the player was identified by both Allano and Jacy shortly after the event.

In addition, the police also asked for images of the transmission with the worker’s lawyer to see if the videos caught the moment Miguelito uttered the racial injury.

How long can Miguelito get stuck?

Miguelito, Bolivian who operates in América-MG loaned by Santos, will be detained until the custody hearing. The police inquiry should be finalized in the coming days.

Law 14,532 of 2023 puts as a crime “to injure someone, offending him dignity or decorum, due to race, color, ethnicity or national origin”. The penalty is two to five years in prison and payment of a fine.
