
The Provincial Court of Malaga has acquitted David Leo García, writer and participant of y The hunterof a crime of ill -treatment and another of vexations against his ex -partner. In relation, he denounced him in early March 2023 after some facts that, supposedly, had occurred inside the room of a hotel in Valencia and at the door of another accommodation in Santiago de Compostela. None of the cases have been “accredited”, according to the judgment signed on March 25 by the magistrates of the Eighth Section, confirmed by the published one year earlier by the Criminal Court number 12 of the capital of Malaga.
David Leo García came to declare in spring of 2024 accused of three concrete facts. And everyone has been acquitted. On the one hand, those that occurred on February 25, 2023 in Valencia, where there was a discussion between both parties “without being accredited that the accused would say ‘shut up a whore, let me sleep”, according to the sentence. The second, three days later, outside a hotel in Santiago de Compostela, when there was a struggle for the key to the room, after which they both fell to the ground “without being accredited that the defendant was throwing a cigarette to the face and kicked him, nor that the accused attacked him causing him the injuries he presented on March 3, 2023” when he filed the complaint, he accused him of a crime of ill -treatment and another of vexations.
The Prosecutor’s Office requested a year in prison, in addition to the prohibition of communicating with the victim and approaching her less than 800 meters for three years. To this, the private accusation added just over 9,000 euros of compensation for the work decline that the complainant had suffered. The defense, however, requested the total acquittal. And he remembered that the complaint had had serious consequences for David Leo García, who had to depart from the program The hunter on Spanish television by their own decision. In a statement, RTVE respected “the presumption of innocence” of the author and assured that the Malaga had decided to depart from the program not to affect the judicial process.
After the oral trial, a first sentence published on April 25, 2024 was issued by the Criminal Court number 12 of Malaga. The man was acquitted of the two crimes, but the ex -partner appealed. Now the Provincial Court of Malaga dismisses that appeal and confirms the acquittal issued in the first instance. “Not appreciating by this Chamber any valuation error of the test practiced or error in the application of the norm that justifies its annulment, the appeal must be dismissed,” underlines the sentence of the Eighth Section of the Malaga audience signed by Pedro Molero, Ignacio Navas and Lourdes Sánchez.
David Leo’s lawyer, Julia Soria, has expressed her satisfaction with Efe for the judicial decision, since, despite the irreparable damage she considers that she has suffered her client, justice has shown that the accusatory story was not true.
