Bolsonaro lawyers deny breach of precautionary measures imposed by the Brazil Supreme

Jair Bolsonaro received a sentence of 27 years and three months in prison by the Federal Supreme Court. It is the first president of Brazil to be convicted of the attempted coup d’état.

In a historic decision of the Brazilian justice, Jair Bolsonaro and seven other defendants were convicted of five crimes, including attempted coup and violent abolition of the rule of law. by the Federal Supreme Court (STF).

Four of the five judges of the First Class of the Supreme Court – Rapporteur Alexandre de Moraes, Flávio Dino, Cármen Lúcia and Cristiano Zanin – voted in favor of the conviction of Jair Bolsonaro. Minister Luiz Fux was the only one to vote for acquittal.

And now?

Bolsonaro and the other convicts – Alexandre Ramagem, Almir Garnier, Anderson Torres, Augusto Heleno, Mauro Cid, Paulo Sérgio Nogueira and Walter Souza Braga Netto – will not be immediately detained because can still appeal the decision of the Federal Supreme Court.

Defendants’ defenses may submit declaration embargoes, appeals used to point out contradictions or request clarifications on certain points of the decision. They have only five days to write and send resources to the process rapporteur.

These embargoes, even if they do not change the sentence decision, may try to change the duration of the penalties. Bolsonaro’s defense is also expected to also request compliance with house arrest, taking into account the health conditions of the former president.

Jair Bolsonaro, who has been under house arrest since August 4, and the other seven defendants will only be arrested when there are no more ways to appeal.
