Originally, the text sought to resume a rule of the 1988 Constitution, which required authorization from the House of Representatives or the Senate for parliamentarians to respond to criminal proceedings. This requirement had been overturned in 2001.
The current proposal determines a period of 90 days for the Legislature to deliberate on the prison authorization or opening of criminal action. This decision should be made in a secret vote, with the need for an absolute majority of the members of the respective house.
In addition to restoring the requirement to endorse Congress, PEC also brings new provisions. Among them, the expansion of the privileged forum in the STF (Federal Supreme Court) to include party presidents representing the National Congress.
During the discussion in the plenary, the mayor, Hugo Motta (Republicans-PB), said that the appreciation of the PEC is an opportunity for the house to resume changes to the constitutional text in the face of “atropolling, abuse that took place against colleagues.”
