The Federal Senate Constitution and Justice Commission (CCJ) unanimously rejected, on Wednesday (24), the proposal of amendment to the Constitution (PEC) of the armor. The proposal, which would give Congress the power to bar the opening of criminal actions against deputies and senators, even when the Federal Supreme Court (STF) identified evidence of authorship and materiality of crimes ,.
Legal assessment
The Attorney General’s Office (PGR) had signaled that it could trigger the Supreme Court if the PEC was approved, pointing out clear indications of unconstitutionality. The backstage evaluation of the Supreme indicated that the proposal violated the principle of separation of powers and the principle of morality, provided for in the Constitution.
The context of the proposal was related to various investigations ongoing, not only about undemocratic acts involving allies of former President Jair Bolsonaro (PL), but also on irregularities in the disposal of parliamentary amendments, reaching politicians of different ideological and parties.
Institutional strengthening
A is seen as a strengthening of the relationship between the STF and the Federal Senate. The conduct of the process by the Senate President, David Alcolumbre (Union-AP), following the normal rite and allowing the CCJ analysis, was interpreted as a positive sign for the institutional balance between powers.
