The senators begin work in 2026, this Monday (2) with at least 24 names in the hearing queue for positions of authority. The list includes nominees for the direction of the Securities and Exchange Commission (CVM), which oversees the stock market and other types of investments.
Lawyers Otto Eduardo Fonseca de Albuquerque Lobo and Igor Muniz had their names published in the DOU on January 7th. Now they will be questioned by the senators of the Economic Affairs Committee (CAE), which awaits official documentation.

According to the commission, only two of five principal directors are currently active, which could delay the judgment of cases.
Indications for STF and other bodies
Among the nominations to be analyzed by the Senate is also that of Jorge Messias (current attorney general of the Union) for the position of minister of the Federal Supreme Court (STF). He must undergo a hearing at the Constitution and Justice Commission (CCJ) before voting in the Plenary.

Messias’ name was announced by President Luiz Inácio Lula da Silva in November last year, and the Senate awaits the sending of the presidential message that formalizes the nomination. Messias seeks to fill the vacancy of former minister Luís Roberto Barroso, who retired in October.

The Senate has already received the nomination of 2 names to make up the 15-member panel of the National Council of Justice (CNJ), and 2 to join the 14 seats of the National Council of the Public Ministry (CNMP), bodies that monitor the performance of judges and prosecutors, respectively.
Three of the nominations are from the Superior Court of Justice (STJ), and one from the Attorney General’s Office.
- Carl Olav Smith, for the CNMP (OFS 19/2025);
- Marcio Barra Lima, for the CNMP (OFS 16/2025);
- Andréa Cunha Esmeraldo, for the CNJ (OFS 18/2025); and
- Ilan Presser, for the CNJ (OFS 17/2025).
In December, the Presidency of the Republic also appointed judge Margareth Rodrigues Costa to occupy the position of minister of the Superior Labor Court (TST).
End of mandates
The number of nominations to be analyzed by senators should increase throughout the year, as in 2026 at least another 38 vacancies should be opened in regulatory agencies, higher courts and other Executive and Legislative bodies whose nominees must undergo analysis by the House.

This year the terms of 8 members of the CNJ and 5 of the CNMP end. The same occurs with the Union’s general public defender, appointed by the President of the Republic. The mandates of:
- 20 directors of regulatory agencies (among them, the National Data Protection Agency — ANPD);
- 1 minister of the Federal Court of Auditors;
- 3 members of the Administrative Council for Economic Defense (Cade).
Furthermore, two STJ ministers may retire in the coming months due to their age of 75: Antonio Saldanha Palheiro and Geraldo Og Nicéas Marques Fernandes.

Previous years
In 2025, the Senate approved 72 nominations for positions of authority. The number was almost double that of 2024, when 37 names were accepted. In 2023, the Legislative House approved 90 nominations of this kind.
