Federal Supreme Court (STF) minister Flávio Dino guided the trial that will decide whether the Amnesty Law, which pardoned political crimes committed during the military dictatorship (1964-1985), applies to cases of political disappearances. THE Analysis was scheduled for the virtual plenary between February 13th and 24th.
Last year, ministers recognized the general repercussion of the issue. As a result, the STF’s position must be followed by all judges and courts in the country. It was minister Flávio Dino who proposed that the Court rule on the application of the Amnesty Law. Dino argued that, in cases of concealment of a corpse, the crime “prolongs over time” and, therefore, in his opinion, it could not be pardoned.
“Maintaining the omission of the location where the body is located, in addition to preventing family members from exercising their right to mourn, constitutes the commission of a crime, as well as a situation of flagrant crime”, he argued.
