The defense of (PL) again asked this Wednesday (11) that the minister of the (Supreme Federal Court) grant house arrest on a humanitarian basis to the former president, who is currently imprisoned in Papudinha, a Military Police battalion next to the Papuda Penitentiary Complex, in Brasília.
In the document presented to the Supreme Court, Bolsonaro’s lawyers state that the former president is “in a situation of serious, permanent and progressive multimorbidity, with a concrete risk of sudden decompensation and potentially fatal events.”
The new request was presented after a PF medical report () released last Friday (6) indicated that Bolsonaro needs special care in Papudinha and is at risk of falling, but that there is no need to transfer to a hospital.
The report, which was prepared at Moraes’ request, concluded that Bolsonaro has chronic diseases under control and recommends regular monitoring, in addition to certain treatments and preventive measures due to the risk of complications.
A Sheet what Bolsonarists’ expectation was that the report would reinforce the demand for the former president to be transferred to house arrest. As this did not happen, the defense ended up frustrated with the expertise. However, the guidance is to reiterate the home stay request.
Now, the lawyers claim that, although Papudinha has received adaptations to meet Bolsonaro’s needs, remaining there still poses risks “either due to the structural limitations inherent to the prison, or due to the dependence on contingent arrangements that are difficult to maintain over time.”
“In this context, the custodial environment remains objectively more dangerous than the
adequately structured home, in which it is possible to ensure greater predictability, therapeutic continuity and immediate response to complications”, they state.
The defense filed with the request an opinion prepared by doctor Claudio Birolini and a report by physiotherapist Kleber Antônio Caiado de Freitas.
The document signed by Bolsonaro’s doctor states that the former president’s condition is “highly complex”, with “chronic and progressive vulnerability, with cardiovascular, pulmonary, infectious and functional risks”, in addition to citing the continuous use of medications such as antihypertensives, antidepressants and anticonvulsants to control hiccups.
According to Birolini, Bolsonaro’s sleep apnea, combined with postural instability and episodes of hiccups, increase the risk of falling.
In January, the former first lady (PL) spoke to Moraes and asked if the minister had given him humanitarian house arrest in May last year. Moraes replied that Collor was diagnosed with Parkinson’s and is at risk of falling.
Bolsonaro completed six months in prison at the beginning of February. He was transferred, initially to the superintendency of the Federal Police and then to Papudinha, after violating his electronic ankle bracelet with a soldering iron last November. Before, he was trapped in his home, in the Solar de Brasília condominium, in Jardim Botânico.
