In the indictment request, the delegate from the 42nd DP (São Lucas), Alexandre Bento, states that they had been careless in caring for the victims and sought to hinder the investigation of the case, including the attempt to mischaracterize the location after the death.

The main line of investigation by the police so far was that the chlorine had been mixed with other chlorine of a different type or brand or some inappropriate product. In both cases, there is the possibility that the mixture may generate a toxic chemical reaction. The person who mixed products was Severino Silva, 43 years old, an employee who did not have the technical training to do so. He states that he was guided by the owners of the place regarding the mixture and dosage, via cell phone messages.

Judge Paula Marie Konno, of the São Paulo Court of Justice, denied the partners’ arrest request. According to their decision, the police and the MP did not present sufficient reasons to justify “the extreme segregation measure”, in addition to having already given testimony. There is no record in the records that those investigated were “intimidating or embarrassing witnesses.”

In a statement, the defense of Cesar, Celso and Cezar stated that they received “with satisfaction the court decision” that gives the trio the possibility of awaiting trial in freedom and stated that they must comply with the precautionary measures. “We reiterate that they remain entirely at the disposal of the competent authorities for any clarifications.”
